1. AGREEMENT TO TERMS
1.1 Acceptance of Terms. By accessing or using the Top Cat’s Retro website (the “Site”), you agree to these Terms and Conditions. If you do not agree, please do not use the Site.
2. INTELLECTUAL PROPERTY RIGHTS
2.1 Ownership. The Site and its content, including text, images, graphics and logos, belong to Top Cat’s Retro or their respective rights holders. You may not reproduce or use them without permission.
2.2 Licence to Use. Top Cat’s Retro grants you a personal, non-transferable, non-exclusive, limited licence to access and use the Site in accordance with these Terms.
3. USER REGISTRATION
3.1 Account Creation. To use certain features of the Site, you may need to register and provide your name, surname, contact number, email address and physical address.
3.2 Account Responsibilities. You are responsible for keeping your account details confidential and for activity under your account.
4. PRODUCTS
4.1 Product Descriptions. Top Cat’s Retro sells a mix of vintage, antique, collectible, handcrafted and custom-made items. Pre-loved pieces may show signs of age, wear, colour loss or blemishes. We make every effort to describe each item accurately and to identify any known imperfections.
4.2 Pricing. All prices are in South African Rand (ZAR). Prices and availability may change without prior notice.
5. PURCHASES AND PAYMENT
5.1 Payment Methods. We accept the payment methods offered at checkout through iKhokha. Please ensure your payment and contact information is accurate.
5.2 Transaction Confirmation. After a successful purchase, you will receive a confirmation email.
6. RETURN AND SHIPPING POLICY
6.1 Returns. Due to the nature of many of our pieces being unique, vintage or made to order, please review the product description carefully before buying. We maintain a strict no-return policy on most items and generally do not accept returns for a change of mind, subject to your rights under South African law. 6.2 Shipping and Handling. We take care when packaging items, particularly fragile pieces. Please contact us promptly if an item arrives damaged or is not what you ordered. Our separate Shipping & Returns Policy, available on the Site, explains the delivery and claims process.
7. PROHIBITED ACTIVITIES
7.1 Misuse of Site. You may not attempt to compromise the security or operation of the Site.
8. USER-GENERATED CONTRIBUTIONS
8.1 Submissions. We do not currently facilitate user-submitted content on the Site.
9. PRIVACY POLICY
9.1 Privacy Commitment. Please review our separate Privacy Policy, available on the Site, to understand how we collect and use personal information.
10. LIMITATION OF LIABILITY
10.1 Site Information and Product Condition. We make every effort to keep Site information accurate, but occasional technical errors, factual inaccuracies or typographical mistakes may occur. Vintage and pre-loved items are sold in the condition described in their listings. Nothing in these Terms excludes any warranty or consumer right that cannot lawfully be excluded.
10.2 Limitations on Liability. To the extent permitted by applicable law, Top Cat’s Retro and its owners, employees and agents are not liable for indirect or consequential losses arising from your use of the Site or purchase of products. Nothing in these Terms limits liability where doing so would be unlawful.
11. DISPUTE RESOLUTION
11.1 Governing Law. These Terms are governed by the laws of South Africa.
11.2 Resolving Disputes. If a dispute arises concerning the Site, a product or these Terms, please contact us so we can first try to resolve it in good faith. The parties may agree to arbitration where appropriate, without limiting either party’s rights under applicable law.
12. TERMINATION
12.1 Termination Rights. Top Cat’s Retro may suspend or terminate access to the Site where a user breaches these Terms or misuses the Site.
13. CHANGES TO TERMS
13.1 Modification Rights. We may update these Terms from time to time. Changes will be posted on this page, and continued use of the Site after they are posted constitutes acceptance of the updated Terms.

15. MISCELLANEOUS
15.1 Entire Agreement. These Terms, together with the policies referred to in them, set out the agreement between you and Top Cat’s Retro concerning use of the Site.
15.2 Waiver. A delay or failure by Top Cat’s Retro to exercise a right under these Terms does not waive that right.
15.3 Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply.
